Terms of Service
Last updated: 7 October 2026
§1. General provisions
These Terms of Service set out the rules for using the Kinect application — an online tool for logging workouts, tracking physical-activity progress, and participating in training communities. The application is operated by Jakub Borkowski, conducting unregistered business activity (Polish: działalność nierejestrowana), Plac Wilsona 4/24, 01-626 Warsaw, Poland (the "Provider"). Contact: contact@getkinect.app.
Creating an account and using the application constitutes acceptance of these Terms. The application is intended for persons aged 16 and over. These Terms constitute terms of service for the provision of services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
§2. Scope of services
Kinect provides tools to:
- log workouts, exercises, and sets (weight, reps), and set training goals;
- view statistics and progress metrics (including Power Score, Body Readiness, activity map);
- use the exercise library;
- create and join training communities (the Tribe feature);
- use artificial-intelligence features (including generating training plans, next-session suggestions, and weekly recaps).
The basic version of Kinect is free. Some features are part of the paid Kinect Pro subscription described in §4.
The Provider may change, add, or withdraw features. Material changes will be communicated in advance.
§3. User account
Using the application requires creating an account. Registration is carried out using an email address and a password meeting the requirements shown during sign-up (at least 10 characters, including upper- and lower-case letters, a number, and a symbol), or a Google or Apple account.
The user undertakes to provide accurate information, keep the password confidential, and not share the account with third parties. One person may hold one account.
§4. Kinect Pro (subscription)
Kinect Pro is an optional paid subscription. It adds:
- the full history — workouts, exercise results and body measurements older than 90 days. On the free plan these entries are hidden, not deleted, and are shown again as soon as Kinect Pro is active; statistics, rankings and records always count the full history;
- generating workouts with artificial intelligence (AI sessions). Every account can try 3 AI sessions free of charge; with Kinect Pro, up to 20 a day.
Everything else, including the weekly AI recap, remains free.
Kinect Pro can be bought only in the Kinect iPhone app, through Apple's App Store in-app purchase, as a monthly or a yearly subscription. The price is shown in the App Store before purchase, in the user's local currency. Payment is collected by Apple and charged to the user's Apple ID account; the Provider does not receive card or payment details.
The first purchase may include a 7-day free trial, once per user, as offered in the App Store. Unless the subscription is cancelled before the trial ends, it starts automatically and the first period is charged.
The subscription renews automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period; the account is charged for the next period within 24 hours before the current one ends. The subscription can be managed and cancelled at any time in iPhone Settings › Apple ID › Subscriptions. Cancellation takes effect at the end of the current paid period, and Kinect Pro remains active until then. Deleting a Kinect account does not cancel an App Store subscription.
Refunds are handled by Apple under its own rules (reportaproblem.apple.com). A refunded subscription ends Kinect Pro.
Kinect Pro bought in the iPhone app is also active when using Kinect in a web browser with the same account. The Provider may also grant Kinect Pro free of charge for a stated period (for example to early users); no payment is taken for it, and when the period ends the account returns to the free plan without losing any data.
Invite a friend. Each account has a personal invite link, and a link to a Tribe shared by its leader works the same way. When a person who creates a new Kinect account through such an invite saves 3 workouts, each with at least one set, on 3 different days within 7 days of creating the account, both that person and the person who invited them receive Kinect Pro free of charge for 30 days. Only invitations accepted from 7 October 2026 count. A person who at that moment already has Kinect Pro from a paid subscription or from another free grant does not receive the period; periods received this way follow one another rather than overlapping. Each person can receive at most 12 such periods in total. The reward cannot be exchanged for money and does not extend an App Store subscription. The Provider may end this promotion at any time (rewards already granted remain) and may refuse or withdraw rewards obtained through abuse, in particular through fake or duplicate accounts.
§5. Right of withdrawal
Consumers in the EU have a statutory right to withdraw from the contract within 14 days of its conclusion without giving a reason, in accordance with the Polish Act of 30 May 2014 on Consumer Rights. A Kinect Pro subscription is bought from Apple through the App Store; withdrawal from that purchase and refunds are handled by Apple under its terms.
§6. Complaints
Complaints regarding the operation of the application and the conformity of the digital service with the contract may be submitted to contact@getkinect.app. The Provider reviews complaints within 14 days of receipt and informs the user of the outcome.
§7. Community features (Tribe)
The application allows users to create and join training communities and to publish content (including community names and descriptions, achievements, reactions). The user publishes content at their own responsibility and undertakes not to post content that is unlawful, offensive, misleading, infringes third-party rights, or is unrelated to the application's subject matter.
The Provider may remove content that breaches these Terms and may restrict or block access to community features for users who violate the rules of their use.
§8. Rules of use
It is prohibited to use the application in a manner that breaches the law or these Terms, in particular: attempting unauthorized access to the application or other users' data, disrupting its operation, automated data collection (scraping), and using the application for commercial purposes without the Provider's consent.
§9. Artificial-intelligence features
The application offers features generated automatically by artificial-intelligence algorithms (including training plans, next-session suggestions, weekly recaps). Such content is informational and supportive only, may be inaccurate or incomplete, and does not constitute coaching or medical advice.
§10. Informational nature and absence of medical advice
Kinect is a tool that supports independent tracking of physical activity. The application does not provide medical or coaching services and does not replace consultation with a doctor, physiotherapist, or trainer. Before starting or changing a training program — especially in the case of health problems — the user should consult a doctor. The user exercises and uses the application at their own risk.
§11. Intellectual property
The Kinect application, its name, logo, interface, exercise library, and other elements are legally protected and may not be used without the Provider's consent. The user retains rights to content they post themselves in the application and grants the Provider a free, non-exclusive licence to use it to the extent necessary to provide the service (including displaying content to other community members).
§12. Liability
The Provider makes every effort to ensure the application works correctly and without disruption, but does not guarantee uninterrupted availability and reserves the right to technical breaks, including those related to maintenance or development. The Provider is not liable for the consequences of training decisions made by the user based on data or suggestions presented in the application. The provisions of this section do not limit the Provider's liability to the extent that such limitation is not permitted in relation to consumers.
§13. Termination
The user may terminate the contract at any time by deleting their account in the application settings or by contacting the Provider. The Provider may terminate the contract or block an account in the event of a material breach of these Terms — after first calling on the user to cease the breach, unless the breach is gross.
§14. Changes to the Terms
The Provider may amend these Terms for important reasons, such as changes to the application's functionality, changes in the law, or security considerations. Users will be informed of changes in the application or by email at least 14 days in advance. The date of the last update is always shown at the top of the Terms.
§15. Final provisions
In matters not regulated by these Terms, Polish law applies, in particular the Civil Code, the Act on Consumer Rights, and the Act on Providing Services by Electronic Means.
A consumer may use out-of-court means of handling complaints and pursuing claims, including by applying to a permanent consumer arbitration court or to a provincial inspector of the Trade Inspection, or for assistance to a district (municipal) consumer ombudsman. Information on this is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
Disputes involving a consumer are resolved by the court having jurisdiction under general rules. The rules for processing personal data are set out in the Kinect Privacy Policy.
